Is Credit Repair Legal?

Yes, credit repair is legal and our credit education and document processing services will help you to use the law in your favor. That law is known as “The Fair Credit Reporting Act.” The FCRA gives you the right to dispute any item on your credit report. If that item cannot be verified within a reasonable time (usually 30 days) it must be removed. Studies have shown that 79% of all credit reports contain errors. This is nearly 8 out of 10 reports. Therefore most credit reports improve immediately. Sometimes the furnisher will say it has been verified but will not offer proof. It is our job to prepare documents that challenge this and we are very skilled at that.

Contrary to what credit bureaus want you to believe, credit repair does work in most circumstances. But it only works if you are getting the best advice from an experienced professional. Anyone with a credit score below 720 can benefit long-term from the advice and information provided through credit education. However, there are limiting factors that will prevent us from helping you. Two main factors are: (1) your credit history – there may be instances where all items on your report are accurate and verified and therefore it may not be possible to improve your score at that time and/or (2) the time frame in which you need to reach your results. It is possible to remove almost anything from a credit report, even accurate items. For instance, if the creditor makes mistakes or does not adhere to the specific time frame, the negative item may be removed. It is recommended to start the credit repair process at least 6 months prior to your need for purchasing a car, home, etc.

The Federal Trade Commission (FTC) and the Consumer Financial Protection Bureau (CFPB) say that you should be wary of companies that claim they can repair your credit quickly or easily. .

Beware and consider not dealing with organizations that offer to create a new identity and credit file for you. The FTC, CFPB, and state attorneys general have filed legal actions against some of these organizations. The FTC, CFPB, and others warn that the following claims or actions signal that you may be dealing with a credit clinic:

  • The company asks for money up front and charges you before they’ve performed their services.
  • The company guarantees to remove late payments, bankruptcies, or similar information from a credit report.
  • The company charges a lot of money to repair credit.
  • The company asks you to write to the credit reporting company to verify the same credit account information in the file, over and over, even after the information has been determined to be correct.
  • The company doesn’t want to or can’t provide a business address.
  • The company pushes you to decide to engage them right away.

There are two sides to the credit score battle. Sometimes, the creditors and the credit bureaus have done absolutely everything right and we have no case against them. On average, clients are able to remove 70% of the negative items from a credit report.

Per federal law, credit services organizations cannot pull credit reports for their clients. Section 604 of the FCRA (Fair Credit Reporting Act) prohibits the credit bureaus from furnishing credit reports to third parties for any reasons outside of the FCRA definition of “permissible purposes” which include determination of credit worthiness, underwriting of insurance, and employment screening. You will need to obtain your own credit reports, and of course, we will be happy to assist you with this process.
